TERMS OF SERVICE

Hello and welcome to Europe RDP! We’re excited to have you on board. These Terms of Service (“Terms”) are a legal agreement between you (our “Customer”) and Europe RDP (“we,” “us,” “our”). They govern your use of our remote desktop server services, our website, and any related software or support (collectively, the “Services”).
By signing up for and using our Services, you are agreeing to these Terms in full. Please read them carefully.
01. Your Account with Europe RDP
- Creating Your Account: To use our Services, you must create an account. You agree to provide accurate, complete, and current information during registration, including your full name, email address, physical address, and phone number. We need this to comply with legal and billing requirements.
- Your Responsibility: You are solely responsible for all activity that occurs under your account. It’s crucial that you keep your account password confidential and secure. If you suspect any unauthorized use of your account, you must notify us immediately.
- One Person, One Account: To prevent abuse of our services and refund policy, you may not create multiple accounts. If we find that you have previously been banned, any new accounts you create will be suspended and potentially terminated without a refund.
02. Acceptable Use of Our Services
We provide powerful tools, and we trust you to use them responsibly. You agree that you will NOT use our Services to engage in, promote, or facilitate any of the following activities:
- Illegal Activities: Any action that violates the laws of the European Union, Germany, the Netherlands, the United Arab Emirates, or your local jurisdiction.
- Hacking & Security Violations: Attempting to gain unauthorized access to any system, network, or data (e.g., hacking, port scanning, phishing).
- Network Abuse: Any activity that disrupts our network or the services of others, including Denial of Service (DoS) attacks.
- Email Abuse: Sending unsolicited bulk emails (SPAM) or any form of mass communication.
- Proxy and VPN Services: Running or providing public VPN, proxy, or tunneling services that anonymize traffic for third parties.
- Resource-Intensive Software:
- Using scripts or software designed to generate artificial traffic (e.g., Traffic Bots, iMacros scripts).
- Operating cryptocurrency mining software that overutilizes server resources and impacts server performance for others.
- Live streaming (e.g., OBS Streaming) or video encoding that places a continuous high load on the server’s CPU and network.
- Fraudulent Financial Activities: Engaging in credit card fraud (“carding”) or any other form of financial crime.
Violation of this Acceptable Use Policy is a serious matter and may result in the immediate suspension or termination of your account without a refund.
03. Payments, Renewals, and Billing
- Billing Cycle: Our Services are provided on a monthly billing cycle. Your payment is due in advance for the upcoming month of service.
- Automatic Renewal: To ensure uninterrupted service, your subscription will automatically renew each month. The monthly fee will be charged to the payment method on file. You are responsible for ensuring your payment information is up to date.
- Non-Payment: If a payment fails, your account will be suspended immediately. We will attempt to notify you to resolve the issue. If payment is not made within a reasonable time, your server and all associated data may be permanently deleted.
04. Cancellation and Refunds
- 72-Hour Money-Back Guarantee: We are confident in our service, and for new customers, we offer a 72-hour money-back guarantee. This period starts from the moment your server details are delivered to you. If you are not satisfied, you can request a full refund within this window by contacting our support team.
- Refund Exclusions: The money-back guarantee is void if:
- You have violated any part of our Acceptable Use Policy.
- You create multiple accounts to exploit the refund policy.
- You engage in abusive, threatening, or disrespectful behavior towards our staff.
- Cancellation: You may cancel your subscription at any time through your client area. If you cancel after the 72-hour refund period, your service will remain active until the end of your current paid billing cycle, and you will not be billed again. No pro-rated refunds are provided for cancellations made after the initial 72 hours.
05. Special Notice for Consumers in the European Union
For customers who are consumers residing in the EU, you generally have a statutory right to withdraw from an online contract within 14 days without giving any reason (Widerrufsrecht
in Germany).
However, for the digital services we provide, this right of withdrawal expires when we begin the provision of the service, provided that you have given your express consent and have acknowledged that you will lose your right of withdrawal.
By placing your order, you expressly consent to us beginning the performance of the Service immediately and you acknowledge that you thereby lose your right to withdraw from the contract.
06. Service Level Agreement (SLA)
- 99.99% Uptime Guarantee: We are committed to providing a reliable service. We guarantee a 99.99% network and server uptime per calendar month.
- Exclusions: This guarantee does not cover downtime resulting from:
- Scheduled maintenance for which we may have provided advance notice.
- Issues with your local internet connection or equipment.
- Actions you have taken that disrupt the server (e.g., software misconfiguration, firewall errors).
- Violations of our Acceptable Use Policy.
- Service Credits: In the unlikely event we do not meet our 99.99% uptime guarantee, we will compensate you. For any verified downtime beyond the guarantee, we will extend your current subscription period by the amount of time the service was unavailable, free of charge. You must open a support ticket to claim a service credit.
07. Account Suspension and Termination
We reserve the right to suspend or permanently terminate your Services, with or without notice, for any of the following reasons:
- Violation of Terms: Any breach of these Terms of Service, especially the Acceptable Use Policy.
- Non-Payment: Failure to pay your invoice on time.
- Resource Abuse: Consistently using server resources (CPU, RAM, Network) in a way that negatively impacts other customers (“hogging”).
- Staff Abuse: Any form of harassment, threats, or abusive language directed at our support or administrative staff.
- Ban Evasion: Creating a new account after a previous account was terminated for cause.
For severe violations (such as illegal activities), termination will be immediate and without refund. For minor issues, we will try to provide a warning first.
08. Privacy and Data
We take your privacy seriously. We collect personal data like your name, email, address, phone number, and IP address to provide our Services, process payments, and prevent fraud. Our handling of your personal data is governed by our Privacy Policy, which is compliant with the GDPR. We encourage you to read it.
You are responsible for any data you store on your server. We do not access or monitor your private files, but we may monitor resource usage and network traffic to ensure the stability and security of our platform.
09. Limitation of Liability
- We are not responsible for any data loss. You are solely responsible for creating and maintaining your own backups.
- Our Services are provided “as is.” While we strive for excellence, we cannot guarantee they will be error-free or uninterrupted.
- To the fullest extent permitted by law, Europe RDP’s total liability for any claims related to our Services or these Terms will not exceed the amount you paid us for the Services in the month the issue arose.
- This limitation of liability does not apply to damages caused by our intentional misconduct or gross negligence, or for injury to life, body, or health.
10. Governing Law and Jurisdiction
These Terms and any dispute arising from them will be governed by and construed in accordance with the federal laws of the United Arab Emirates as applied in the Emirate of Dubai. You agree to submit to the exclusive jurisdiction of the courts of Dubai for the resolution of any disputes.
11. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will post the most current version of these Terms on our website and update the “Last Updated” date at the top of the page.
